Welcome to Consultwebs.com’s estate planning resource site. First, we are not attorneys and do not provide legal advice. You should consult your attorney for estate planning advice. We do, however, provide current, helpful legal resources.

The definition of an estate is, "all assets owned by an individual at death, to be distributed according to the individual's will" (or a court ruling if there is no will).

Estate Planning is the process of organizing your assets and legal documents to meet your goals before and after your death. The goal, after death, is typically to pass the maximum estate to our heirs. Property owned at death is transferred either by either a will and probate, or by trust. The owner of an estate a great deal of freedom in determining how an estate is to be distributed. Exceptions include disinheriting one’s spouse, unless a prenuptial agreement was executed. Children also have special "homestead property" rights.The law safeguards the decendants wishes through "Probate of an Estate."

A probate is the review or testing of a will before a court of law to ensure that the will is authentic. Also, the process by which an executor (if there is a will) or a court-appointed administrator (if there is not a will) manages and distributes a decedent's property.Fees, expenses and other estate costs include attorney fees, taxes, court costs. These typically average five to eight percent of the assets subject to probate.A common method of avoiding probate costs estate taxes is a Trust. A Trust is a legal arrangement in which an individual (the trustor) gives fiduciary control of property to a person or institution (the trustee) for the benefit of beneficiaries.
